Conditions of Participation for 99cams

§ 1 Subject of the Conditions
Partnerpages AG has developed the sender and chat software "CamClient.exe" for a direct transmission of pictures and to display artistic, erotic and other kinds of presentations. The visual presentation is accompanied by the possibility of direct correspondence with the internet user.


In the internet the Partnerpages AG provides a platform at the main domain www.99cams.com. Here the sender of picture and chat presentations have the possibility to display their content to the prospective customer and to get into written contact with him.


The software can be used by a multitude of senders. Partnerpages AG undertakes supporting services, as technical support and accounting.

The contract about the offered presentations materialize only between sender and user. Resulting connections are exclusive matters of sender and user.

The sender commits himself to accept the following contract conditions:

§ 2 Services of the company
Partnerpages AG operates a web server farm where the system of 99cams is operated and which is constantly connected to the internet.

Prospective customers with access to the internet, have the possibility to receive gratis information about the content during 24 hours.

Partnerpages AG will strictly pay attention that senders as well as users are of full age and will prosecute possible violations. The payable access is enabled only to adults and is verified by a suitable AVS-System.

The technical connection between user and sender is directly realised. Partnerpages AG logs the particular sessions and has no influence on the quality of the connection. Exceptions for the availability of the web server are periods in which the web server is not connected to the internet due to technical or other problems which are not in the sphere of influence of Partnerpages AG, eg force majeure or default of a third party etc.

The sender records pictures by a digital camera which is installed at his PC. The sender and chat software "CamClient.exe" provided gratis by Partnerpages AG enables him to transmit those pictures to the user.

Picture, video, sound and graphic material of any kind supplied by Partnerpages AG is copyrighted by Partnerpages AG.
Partnerpages AG entitles the sender to use the software within the scope and for the duration of the contract. Releasing picture material or its usage rights to a third party is forbidden, as long as it does not serve for commercial purposes of the 99cams system.

The sender and chat software CamClient may be used only in connection with 99cams. The sender commits himself neither to impart nor to copy the sender and chat software CamClient nor to make it access able for third.

The right to use the sender and chat software CamClient expires with ending of the contract.

§ 3 Commission
Partnerpages AG collects the earned amount of the sender and after subtraction its commission transfers it to the sender. The details of the commission result from the data in his accounting area.

§ 4 Services of the sender, taxes, social security
The sender can choose content, type and duration of his presentation.

The sender renders his service at his personal location, which may be situated in Germany or in a foreign country.

The sender owes the Partnerpages AG a commission as described in the accounting area. The sender accepts that those regulations may be changed by Partnerpages AG at any time. An alteration has to be announced to the sender in a written way. A written notification to his e-mail-address is sufficient.

The sender is responsible for the taxation of the amount he earned. He is bound to pay all charges of insurance contributions, particularly social security contributions and health insurance contributions. Within his activities in the 99cams environment he commits himself to abstain from any kind of advertising that is not connected to his participation in 99cams. The sender is committed to pay a 5.000,00 € fine to the Partnerpages AG for each violation against the regulation of unauthorised advertising. The assertion of further claims is expressly reserved. Furthermore the Partnerpages AG is entitled to cancel the contract without notice.

The sender grants the Partnerpages AG the exclusive and unrestricted right of the picture, video, sound and graphic material provided by him in the context of his participacion at 99cams.

The sender accepts that Partnerpages AG cannot avoid and prosecute the unauthorised and illegal propagation by a third party.

§ 5 Prohibition of illegal pornography, contract penalty, unauthorised advertising
The system of 99cams is offered by adults to adults. For the economic success and the reputation of the service it is essential that the legal regulations are strictly followed by the sender. Absolutely forbidden is the presentation of pornography with children, adolescents, animals and the glorification of violence.

Partnerpages AG will check the compliance with the regulations by spot tests. The connection between sender and user will be cancelled immediately in case of suspicion.

The sender has to pay a fine of 5.000,00 € to the Partnerpages AG GmbH in case of violating the regulations concerning illegal pornography according to German law. The assertion of further claims is expressly reserved.

Partnerpages AG prosecute senders who offend against German law in the 99cams system.

Partnerpages AG collaborates with many webmasters and senders, who use the 99cams system. It is therefore forbidden to place advertising for different websites during the chat, forum or pictures. It is not allowed to name other internet addresses or telephone numbers. It is forbidden to insult users or other senders. Partnerpages AG will give the violator a warning. In case of disregarding of the warning, Partnerpages AG will dismiss the cam without notice.

§ 6 Duration of the contract, cancelation & the consequences
The contract is entered indefinitely.

The contract can be cancelled by both sides in a written way. The cancellation takes effect 24 hours after reaching the other party. It is not necessary to give reasons.

This does not effect the right of cancellation without notice. Reasons for cancellation without notice are:
- the sender is younger than 18 years
- the sender enables persons younger than 18 years access to the system of 99cams
- the sender shows illegal presentations as e.g. pornography with children, animals or glorification of violence.

After termination of contract the sender has to delete the sender and chat software CamClient and all other created copies.

§ 7 Limitation of liability
Partnerpages AG is responsible for damages caused carelessly or wilfully by itself or auxiliary persons. Financial loss caused by violation of essential contractual obligations through simple negligence limits the liability to a maximum of 2.500,00 €. For the rest, liability is excluded.

§ 8 Applicable Law, Jurisdiction
The contract underlies German law. Place of execution for all contractual commitments is the office of Partnerpages AG. If the sender is a salesman, he underlies the local court of the area, where his office is situated. Partnerpages AG may bring charges against senders, who are salesmen, at their office or living location as well as in Mönchengladbach.

§ 9 Other
Alterations or complements of this contract are valid only after a written agreement. This applies as well to this clause. If one of the contractual conditions is or becomes invalid or should the contract contain a loophole, the effectiveness of the other conditions will not be effected. The invalid condition or the loophole will be replaced by a similar regulation, that would have been choosen by both parties, if the invalidity of the condition had been known.
